I was thinking about reaching out to the real "geek" experts of the world to help me finesse the system. BUT, much to my amazement, I didn't have to do that.

They are following the guidelines set by both the legislature and the NRC in making the OBR a permanent rule. No big deal just making it permanent. The comment period is a requirement of that process to make it legal.
