Just received an email from Gene Hopkins...stating the shooting preserve bill was defeated in the Senate.

No particulars...just a one liner.

I think it was 25-23 with all Democrats and a host of Republicans (including my own) voting against the bill. Unexpected to say the least. I watched the webcast and there wasn't any discussion just the vote. I guess the Attorney General goes forward with the appeal.

My opinion? I think the animal rights people got on the phone and beat on a few key senators. It will be back again. By the way it only needed 26 votes to pass. The last and deciding vote was made by Senator Mike Crider!!!!

A bill that would end a yearslong stalemate and provide a legal framework for high-fence hunting preserves in Indiana failed to advance, 25-23, in the Senate, just one vote shy of passing. But the bill may not be dead. Two senators who were absent because of illness could swing the vote if the measure returns before the end of this brief legislative session.

Sen. Brent Waltz, R-Greenwood, said he and some other senators opposed the bill on the grounds that it’s unethical to shoot deer in fenced enclosures.

Senate Bill 404, authored by Sen. Carlin Yoder, R-Middlebury, would provide a regulatory framework for an industry that has been working without one for the better part of a decade. Four preserves sued the Department of Natural Resources in 2005 after it tried to shut down the facilities. A court in 2006 issued an injunction prohibiting the DNR from enforcing its ban. As the court case played out, the preserves have operated without any hunting oversight, hosting hunts in any manner they chose.

“If we don’t pass this bill, deer will be hunted in ways that we can’t control,” Yoder told the Senate.

Harrison Circuit Judge John Evans ruled last fall that the DNR overstepped its authority in shutting down the preserves.

Yoder’s bill would set annual permitting fees, annual state inspections and create standards for hunting farm-raised deer. Fenced preserves would have to be at least 160 acres, and the bill would prohibit hunting deer that had been recently released or near feeders.

Attorney General Greg Zoeller’s office is appealing the case because it would eliminate the wildlife agency’s authority to regulate hunting behind a fence. (Ryan Sabalow, The Star)

Dear IWF Members,

We spoke too soon--The canned Hunting bill (SB404) that did not pass out of the Senate earlier this week may not be dead!

It's our understanding that the language to legalize canned hunting will be amended into SB52 Criminal plenalties and DNR. SB52 was approved by the Senate and is now in the House.

See the attached Roll Call Vote from 2013 to learn how your State Representative voted on canned hunting last year. It was a close vote but the House did approve canned hunting. This year we have an opportunity to educate our State Representatives and let them know Hoosiers do not support canned hunting.

Canned hunting threatens wildlife health, is not fair chase ethical hunting, and threatens Indiana's $314 million wild deer hunting economy.

Please contact your Representative and ask them to vote NO on canned hunting if amended into SB52 or any other bill. Find your legislator here.

Canned hunting was stopped in the Senate--Now let's stop it in the House! Thanks for all you are doing for wildlife and hunting ethics.

It hasn't happened yet. SB52 passed out of the senate and was sent to the House. There's a real possibilty it will get amended in the House Natural Resources Committee by ading the SB404 preserve bill to it. Happens all the time. The trick is to stop it in the House. 2 ways to do that are stop it in committee or stop it on the floor. Write to all the committee members and ask that SB52 either be defeated or not amended. Also write to your own legislator and ask them to vote down SB52 or any amendment to it.

I've sent my emails. What everyone needs to understand though is that generally speaking politicians don't listen to their constituents but instead listen to those that donate money or have dinner with them. The conservative party in this state seems to be moving this approach to an even higher level. I am one of probably many people anymore that can't find it in themselves to be supportive of either political party and certain wish there was an alternative.

So, this is where I don't understand....

Senate bill passes and moves on to the House.
Another Senate bill fails, but gets ammended into the bill that passed at the House level.

If the amended bill passes House, does it go back to the Senate?

It goes to conference committee...the original author has to agree to the change...then it goes back to the originating house to get passed with amendment.

Note that SB52 has been assigned to the House Courts and Criminal Code committee. I doubt SB404 language would go there. In reality the language in question that could create law for the preserves could go to any bill in either House although I think it more likely to show up on something in the House or Senate Natural Resources committees. Anyway keep your eyes peeled as this is prime time for political tricks.

Today was the last meeting of the Senate Ag and Natural Resources committee and canned hunting language was not amended into any bills. So, we’re pretty sure it’s dead for this year. The last day of the legislature is March 14—that’s when we’ll really celebrate. If by some strange route canned hunting does make it to the Senate floor, we believe we have the NO votes to defeat it outright.



Thank you to everyone who contacted their legislator. We were out funded and are 99.9% volunteers, and we got the job done. All conservationists should see this for the important victory it is---grassroots voices speaking up. The supporters of canned hunting, including Farm Bureau, have full time paid lobbyists who worked hard on this issue—but did not win the day.



You can bet this will come back next year, but hopefully the court of appeals will settle the dispute once and for all. Canned hunting is illegal in Indiana and always has been.



Thanks again. That phone call, visit, or email to your legislator may not have seemed like much but look what an outcome!

Thanks Joe. I sure hope SB52 doesn't get passed either. Frankly, some I talked to at the show thought SB52 might be more damning then the canned hunting. Neither are any good.

Just learned Rep Messmer is trying to amend the shooting preserve bill onto SB4 TODAY! I beleive this is the Right to hunt and fish bill......

These folks will never give up!

there are not enough votes in the Senate for it to pass, but SB 4 would die also, that is if it did not get removed in Conference commitee

They juggled the schedule to get the easy items out of the way first. They are out to lunch now so I'd check back around 2 PM. SB4 and SB52 are back to back. Expect both to pass with requisite amendments and some objections from the Dems but not enough votes to stop either one.

Strangely SB4 was amended but only to allow the option of lifetime licenses (up to the NRC if they want to do this). No mention of canned hunting. Started watching at 10 AM and just got to SB4. I did leave for awhile and it looks like SB52 was amended and ordered to engrossment. It's still not over.

The amendment that passed on SB52 added language about lights on boats, it also struck the words knowIngly and intentionally in different parts of the bill.

Both bills now go to 3rd reading on Monday and then to conference committee since they are different than the Senate versions.

How do you find out what the amendment was? Ive looked and can find it no where. h.h.

click on live link jack posted
then click on house calendar
then click on bill you want view
then click on Bill versions....
your then see the amendments....click on them.

Briefly the 3 bills of concern (for me) were SB404 (canned hunting); SB52 (changes misdeanors to infractions); and HB1307 (DNR hosekeeping bill).

SB404 was defeated by a single vote in Senate and although was reported to rise again it never did.

SB52 was passed but was amended to remove the section affecting Indiana Code IC14-22 which is the Natural Resources section. It will be reviewed in depth this summer and reappear next year. Maybe with some tweaks it will become something I can support.

HB1307 was amended to include lifetime licenses. The last I saw it was still in there although the wording was that the NRC "may" issue lifetime licenses and that the NRC would set the price. The NRC most likely would never issue such a license again and if they did they would cost more than $5,000.00. That amendment may have been removed altogether from the talk I heard today.

It passed but since it was changed (much like the gay maariage act) it has to pass another session unchanged and then goes to voters. To me this was a desired result. All of these passing bills must be signed by the governor or vetoed.
